Huntington Beach City Attorney confident his defeat of SB 54 will stand against appeal

Huntington Beach successfully won its case against the “sanctuary state” law, but the decision could be overturned on appeal.  ​

Orange County Superior Court Judge James Crandall agreed with Huntington Beach City Attorney Michael Gates, that SB 54 infringes on the city’s charter.  Gates says he will win if the decision is appealed – as long as the court reads the state’s constitution.

“It says right there that a local affair for a charter city is managing its police force; It’s right there in the constitution and no state law can supersede the state constitution.”

He said if Sacramento were to succeed in this bid to micromanage local affairs, it could theoretically go far beyond the issue of SB 54.

“If the state can basically send out one size fits all policy and programs for every corner of California then it obviates the need for local control and local city councils and local police departments.”
