A US attorney will quit January 6 and that is shaking up the pot industry.
The US Attorney for the Northern District of California, Brian Stretch, covers the Bay Area, and Humboldt, Mendocino, and Del Norte counties, arguably the birthplace of the pro-pot movement and areas where many pot farms are located.
Chapman University Constitutional law professor Dr. John Eastman says the US attorney who replaces him will have the power to enforce federal drug laws.
“It’s certainly within their authority to appoint the new US attorney and to make an appointment of somebody who’s views on these things line up with their own enforcement priorities. There are different tactical views on how best to keep our community safe.”
The announcement follows Attorney General Jeff Sessions decision to rescind the Cole Memo, the Obama-era rule that essentially discouraged federal prosecution of marijuana laws, and encouraged US attorneys to exercise their own discretion in prosecuting cannabis cases.
