A judge is dismissing a lawsuit filed by the former cover model on Nirvana’s 1991 ‘Nevermind’ album. ‘Nirvana Baby’ Spencer Elden claimed the photograph of him as a naked infant constituted child pornography. He accused the band members, the photographer, the graphic artist and the record label of exploitation. In a December 23 hearing, Nirvana’s lawyers pointed out that Elden had recreated the album cover several times as an adult to profit off the fame. They also argued that his claim had no merit since the statute of limitations had expired on the charges he was seeking.
