State Senator Dave Min is introducing a bill that would give the Secretary of State the authority and obligation to review a candidate’s eligibility before placing them on the presidential ballot.
The legislation covers the U.S. Constitution’s 14th Amendment, which states no person involved in insurrection or rebellion against the U.S. shall hold the office of president.
In December, the SF Chronicle said Min “hopes the bill will move quickly. He plans to introduce it in January with an urgency clause, which allows laws to take effect immediately if they are approved by two-thirds of lawmakers and signed by the governor. It’s too late for the proposal to apply to California primary ballots, but it could take effect before the 2024 general election.”
Secretary of State Shirley Weber declined to remove Trump from the state’s primary ballot arguing the California Constitution does not give her clear authority to take the action and leaves the decision to the courts.
