Judge Moves Forward With Wrongful Death Lawsuit Against BART

A wrongful death lawsuit against BART is moving forward. A Superior Court of California judge ruled this week that the family of Corazon Dandan can continue with their wrongful death lawsuit against the transit agency. The 74-year-old Dandan was killed when a homeless individual shoved her in front of an oncoming BART train last year. Her family has argued that BART is to blame for her death, saying the transit agency didn’t take the necessary steps regarding security at the station to keep Dandan and other riders safe. They say BART knew the suspect was a known criminal and fare jumper who once again had not paid his fare when he shoved Dandan in front of the train. The suspect was ultimately charged with murder but his case was suspended this week after he was found not competent to stand trial.
