The Supreme Court may soon decide if states like California can count mail-in ballots that arrive after Election Day, as long as they’re postmarked on time. About one-third of Americans voted by mail in 2024. California counts mail-in ballots postmarked by Election Day if they arrive within seven days. The Supreme Court is signaling it may review a case out of New Orleans after a lower court said only ballots received by Election Day should be counted. Rick Hasen, a UCLA law professor, tells the San Francisco Chronicle the court often take cases to reverse a lower court’s order. He says the court is likely to say the states can decide if they want to accept late ballots. The court is expected to hold a hearing in the spring, with a ruling due in by the summer.
