Sacramento County District Attorney Thein Ho gets a partial victory in his fight against homeless encampment on the streets of Sacramento. A judge issuing a tentative ruling Thursday that Ho’s lawsuit against the city can move forward although a major piece was stripped away.
Judge Jill Talley is siding with the city that a constitutional separation of powers exists between the government and the DA. That means the bulk of Ho’s case, that the city is not doing enough to solve the problem, is out.
Talley did agree that the part of the lawsuit which claims Sacramento is violating the environmental code by allowing the homeless to pollute creeks can proceed.
A hearing on the judge’s tentative ruling is scheduled for Friday morning.
