California and federal officials disagree on how to handle undocumented inmates in state prisons. Sanctuary laws limit cooperation with federal immigration, but state prisons are partly exempt. Federal officials want more cooperation from California. California prisons have transferred over 12 thousand people to ICE since 2019, with all inmates born outside the U.S. reported to ICE for possible custody after release. ICE says California puts people at risk by not honoring a 48 hour hold after their release. Newsom’s office says prisons will not hold people past their release date, if ICE misses out, that’s on them.
